Ergo Injuries on the Rise. What Can You Do?
A Government Accountability Office (GAO) report reveals that ergonomic injuries in U.S. warehouses are increasing, with the injury rate surpassing the national average for all workplaces. The GAO recommended several actions for the Occupational Safety and Health Administration (OSHA) to address these injuries. However, due to a 1995 law blocking ergonomic regulation, these recommendations are unlikely to be implemented. Notably, Amazon significantly contributes to the high injury rates, with its warehouse injury rate being 6.6 per 100 workers, over half of all ergonomic injuries, despite employing only one-third of warehouse workers.
The GAO report calls for OSHA to update guidance, improve inspector training, and track ergonomic hazard letters. However, OSHA Deputy Administrator James Frederick argues the agency’s "general duty clause" and general ergonomic guidance are sufficient for warehouses, prioritizing industry-specific standards for sectors like healthcare. Critics like Senator Bernie Sanders blame corporate greed, particularly Amazon’s refusal to address dangerous working conditions, while others push for increased fines and better worker protection. However, due to past legislative actions, meaningful change remains difficult without repealing anti-ergonomics laws.

RULE CHANGE
New Rule for Offshore Energy Operations.
The Bureau of Safety and Environmental Enforcement (BSEE) has finalized a rule that formalizes the review and approval process for projects utilizing "new or unusual technology," such as equipment designed for high-pressure or high-temperature environments. Set to take effect on October 29, the rule aims to enhance safety for offshore workers and protect the environment, particularly under challenging conditions.
The rule applies to technologies not previously used under expected conditions in a specific BSEE Outer Continental Shelf region or those with operating characteristics outside current regulations. Key features include:
Requiring operators to submit detailed information early in the process to assess project feasibility.
Adding equipment standards, especially for safety barriers, by incorporating industry standards.
Mandating independent third-party reviews in some cases to ensure the viability and safety of projects.
This rule is intended to provide clarity, consistency, and improved safety for offshore energy operations.
NIOSH
New NIOSH Initiative for Firefighters.
NIOSH has launched its Center for Firefighter Safety, Health, and Well-being, aiming to enhance the health and safety of firefighters by addressing the unique hazards they face. Announced on October 7, the center will focus on both immediate dangers and long-term health risks, coordinating research on issues like hazardous exposures and PPE. It will also oversee the National Firefighter Registry for Cancer, conduct health hazard evaluations, and lead fatality investigations. NIOSH Director John Howard emphasized the center’s role in protecting firefighters, while IAFF President Edward Kelly expressed support for making this dangerous job safer.
